Legionnaires' outbreak hits Ohio retirement center

COLUMBUS, Ohio (AP) ? Health officials say Ohio's largest outbreak of Legionnaires' disease has killed five people and sickened 39 others at a retirement community since July.

The state Health Department says the outbreak at Wesley Ridge Retirement Community in Reynoldsburg in central Ohio has been linked to bacteria in an air conditioning cooling tower and several water sources.

Victims range in age from 63 to 99. About 200 people live at the center.

Legionnaires' disease isn't contagious. The rare form of pneumonia is contracted when people breathe in tiny droplets of contaminated water.

The retirement community has taken steps to clean the water by hyper-chlorinating and superheating it. The center is also installing filters on shower heads and advising residents not to drink the water until testing is completed.

Health officials believe those steps have prevented any new infections.

Isner, 2-time champ del Potro in Washington final

A couple of plastic sandwich bags filled with ice were resting on his left thigh, and some others were chilling his right knee, as an admittedly exhausted John Isner assessed how he's holding up after eight victories in 10 days.

"My body doesn't feel great," Isner said, then paused and smiled. "At the same time, nothing is wrong with me, besides just being a little tired and a little worn out. But that's what happens when you play well."

The highest-ranked American man certainly has been doing that lately. Isner, who is ranked 20th and seeded eighth, set up his sternest test of late, earning a matchup against top-seeded and two-time champion Juan Martin del Potro in Sunday's Citi Open final.

Taking control by breaking serve immediately after a rain delay, Isner hit 29 aces and beat unseeded Dmitry Tursunov 6-7 (7), 6-3, 6-4.

Later, del Potro came out much stronger after his semifinal was interrupted for more than three hours by showers and he turned things around to beat third-seeded Tommy Haas 7-6 (4), 6-3 in a match that ended past midnight.

"The rain, for sure, helped me to come back in this match," said the seventh-ranked del Potro, who hasn't dropped a set in three previous victories against Isner.

Del Potro stretched his winning streak at the hard-court tuneup for the U.S. Open to 13 matches. He won Washington's tournament in 2008 and 2009, then skipped it the past three years.

Trailing Haas 4-1 when a downpour came, 2009 U.S. Open champion del Potro won four games in a row.

"The rain delay's annoying. It bothers me a lot, actually," said Haas, who showed frustration at various moments by spiking, tossing or kicking his racket.

"Come back out there, and the momentum was really on my side, at least for the first set, I think. (If) it would have been mine, it would have been maybe a different match. But these are all the `ifs' and `buts' and not worth talking about."

Still, Haas actually held two set points late in the first, one of which del Potro erased with a 117 mph second-serve ace, and the other with a volley winner.

"He went for it," said Haas, a finalist last year. "He deserved it."

Because of all the delays, unseeded Andrea Petkovic's 7-5, 6-3 victory over No. 4 Alize Cornet in the second women's semifinal did not start until after 12:30 a.m. Sunday _ and did not finish until after 2:10 a.m.

Petkovic, seeking her first title since 2011, was scheduled to return to the court about 15 hours later to meet defending champion Magdalena Rybarikova in Sunday's final. Rybarikova beat Ekaterina Makarova 6-2, 6-0 in a semifinal stopped by rain at 5-2 in the first set.

Much, much earlier, Isner finished with a flourish _ his last six serves were aces _ and continued the strong form he showed last week while winning the title at Atlanta on a hard court.

"When you're winning, you're playing a lot of matches, and from that, naturally, you're just going to wear down," said Isner, who was visited by a trainer in the third set but said the left leg injury that forced him to stop playing at Wimbledon in June was not bothering him.

"I just wanted to get it massaged a little bit," said Isner, who for years has been officially listed as being 6-foot-9 by the ATP, but the tour's website recently changed that to 6-10. "It wasn't anything I was seriously worried about."

Isner, the 2007 runner-up in Washington, acknowledged his body feels "like it's a little beat up" after a second consecutive three-setter and a busy 1 1/2 weeks, "but I'll be ready to go tomorrow, for sure."

After dropping the first set against Tursunov, Isner was ahead on serve 2-1 in the second when, with the match 70 minutes old and a drizzle falling, play was suspended. When they resumed at 30-40, Isner converted the break point with a forehand passing winner on a 12-stroke exchange.

"It's definitely not a comfortable feeling" to return from a delay facing break point, Tursunov said. "Really, you understand that if you don't win this point, you're down a break, and then the set is over."

Indeed, that was the first break in the match, and all Isner would need to even things at a set apiece 15 minutes later.

"Gave me all sorts of momentum," Isner said.

He broke again to lead 3-2 in the third, this time at love, helped by three unforced errors by the 61st-ranked Tursunov.

That was pretty much that, because Isner's powerful serve was clicking _ just as it usually does during the summer hard-court season in North America.

"It's my absolute favorite time of the year," said Isner, whose best Grand Slam showing was a run to the U.S. Open quarterfinals in 2011. "It's not a coincidence that I play and do well here in the summer, every single year."

Isner won 69 of 86 points he served Saturday, including runs of 16 and 14 in a row, and did not face a break point.

"You really can't see the serve too well. ... It's really just a lot of guessing," Tursunov said.

Said del Potro, looking ahead to facing Isner: "Nobody can break his serve in this tournament. ... Of course, sometimes you get frustrated when you can't return his serve."

If Isner wins Sunday, he would earn his third title of 2013 and pull even with No. 1 Novak Djokovic for the third-highest total on tour. Only Rafael Nadal (seven) and Andy Murray (four) have won more.

As for whether a ninth match in 11 days might force him to reconsider his schedule over the coming weeks _ the year's last major tournament starts in New York on Aug. 26 _ Isner said he hasn't thought about that yet.

"I want to be as fresh as I can for the U.S. Open," the 245-pound Isner said. "I have played a lot of matches (and) I'm not necessarily built to play week after week after week."

Iran's Rohani vows not to surrender to sanctions

Pledging moderation at home and ?removing tensions? abroad, Iran?s new President Hassan Rohani took the oath of office before legislators today in Tehran.

The veteran regime insider who was Iran?s top nuclear negotiator a decade ago vowed to improve the economy and lives of all Iranians.

But it was Rohani?s explicit reference to US-led sanctions and Iran?s controversial nuclear program that drew the loudest applause and will be most closely followed in Washington. As nuclear negotiations over Iran?s program remained deadlocked, both wings of Congress last week took steps to add yet more sanctions, with the House voting overwhelmingly to tighten restrictions.

Iranians will ?safeguard their national interests? and ?cannot be made to surrender through sanctions; such a people cannot be threatened to war and fighting,? said Rohani, according to a simultaneous translation by state-run PressTV. ?The only way for interaction with Iran is a dialogue on an equal footing, confidence-building which should be mutual, and mutual respect as well as reducing antagonism and aggressiveness... I want to clearly express, that if you want the right response [on the nuclear issue], it should not be through the language of sanctions, it should be through the language and discourse of respect,? Rohani said, prompting the loudest applause of his swearing-in speech.

Tasked with restoring the health and credibility of Iran?s Islamic system after eight years of the often-tumultuous presidency of Mahmoud Ahmadinejad, Rohani called on divine guidance to help him solve Iran?s problems. Supreme Leader Ayatollah Khamenei also called for ?maximum cooperation? and support for Rohani?s government from all of Iran?s political factions at a smaller ceremony on Saturday at which Khamenei officially bestowed his endorsement.

But in a reminder this week of who wields ultimate authority in the Islamic Republic, Khamenei also vetoed some of Rohani?s initial cabinet choices. Some of those he rejected served under reformist President Mohammad Khatami, one of the few senior Iranian politicians not to take part in inauguration events, or criticized Khamenei?s violent crackdown on street protests in 2009. Still, through negotiation, Rohani has presented an inclusive cabinet of experienced technocrats who span much of Iran's political spectrum.

?The balance of power has not changed. The Supreme Leader remains the supreme leader, he?s the final arbiter. But he is not as powerful as he was before,? Nazanin Ansari, the diplomatic editor of Kayhan London newspaper, told BBC World Service Radio. ?He is a candidate that is seen inside Iran who has the best chance to take the Islamic Republic out of its current quagmire. And in the West, he is certainly viewed as someone who can open the doors. But he has to prove that he can.?

Rohani's words

Rohani repeatedly referred to his government as one of ?hope and prudence" and said that he would not shy away from tackling ?shortcomings and deficiencies.?

?The respected people of Iran voted for moderation and distancing from extremism,? said Rohani, standing at the flower-bedecked podium inside Iran?s cavernous and futuristic pyramid-style parliament building. ?The threats will be reduced, and the opportunities must be increased. So moderation insists on moral values, and patience, and compromise.?

Those were all attributes in short supply during the presidency of Mr. Ahmadinejad, whose record was harshly criticized even by fellow hardline conservatives during the campaign leading to the June 14 vote. Running as a centrist and promising reform Rohani got the backing of Mr. Khatami and former President Akbar Hashemi Rafsanjani. The new president trounced five conservative candidates and won a surprise first-round victory with just over 50 percent of the vote.

The ascent of Rohani reflects a ?rising rationality and a big tendency toward moderation? in Iran, says a Tehran analyst who asked not to be named. ?Radicalism is no longer accepted in society.?

Yet it remains unclear how that dynamic will affect nuclear talks, or how far Rohani will be able to recalibrate Iran?s approach with the rest of the world. Khamenei has said in recent weeks that he has not blocked nuclear talks or dealing with the US, but that past experience makes him pessimistic because ?Americans are untrustworthy, irrational and dishonest.?

Rohani has a PhD from Scotland, and the candidate he named today for foreign minister ??Mohammad Javad Zarif, Iran?s former United Nations ambassador ? was educated at the University of Denver.?

Presidential limits

While recent Iranian presidents have done much to shape Iran?s political space ??and have been able to convince Khamenei to move one way or another ? they have also always been subject to any limitations Khamenei decided to impose upon them.?

?Over the past two decades, Khamenei has developed several mechanisms to control the presidency and other democratic institutions,? writes Mehdi Khalaji, an Iran specialist at the Washington Institute for Near East Policy, in an analysis this week. ?Tensions between the president and Supreme Leader are inherent in the structure of the regime, regardless of personality or ideology.?

Still, many of the steps that Rohani vows to take are those that Khamenei will share, at least for now after the Ahmadinejad era saw direct challenges to the leader?s own authority.

And today Rohani had his own indirect reminder for Khamenei when he quoted the leader of Iran?s 1979 Islamic revolution, Ayatollah Ruhollah Khomeini, as saying that ?everything must be based on the people?s vote. That?s the benchmark and the yardstick.?

Woman gives birth in Subway restroom in Nevada

(AP) ? It was just another day at work for Flora Vargas until a screaming woman burst into her Subway sandwich shop in Nevada on Friday and announced she was in labor.

After the pregnant woman raced for the women's restroom, assistant manager Vargas and her boss sprang into action, placing sandwich wrappers and trash bags on the floor for sanitation.

With Vargas' help, the mother gave birth on the restroom floor in Minden, 40 miles south of Reno, a couple minutes later.

"It was a boy. A beautiful boy," Vargas told The Associated Press. "He didn't cry when he came out. Then he cried, and I breathed easier knowing he was alive."

No customers were in the restaurant at the time of the 9:30 a.m. birth, but the restaurant was open. The only employees inside were Vargas and the manager.

Vargas helped calm down the mother and get her on the restroom floor, she said, and it was "a blessing" that paramedics from the East Fork Fire and Paramedic District arrived in time to assist in the delivery.

"The head of the baby was already out when she went to the floor," Vargas said. "The baby came out really, really fast. Fortunately, the emergency service people got here really fast."

Paramedics transported the mother and child to Carson Tahoe Regional Medical Center, where hospital spokesman Jon Tyler said he could only disclose that both are healthy. Their names were not released.

Vargas said the mother told her that she was 21 and had three other children. The mother was accompanied by a sister at the time, she added.

East Fork Battalion Chief Ron Haskins said paramedics have delivered babies in odd places, but it's the first birth on a restaurant restroom floor that he can recall during his 30 years with the district.

"We've delivered babies in cars and restrooms at home, but it's all part of the job," he said. "It's one of the most positive parts of our job."

When she entered the business, Vargas said, the mother was "screaming real bad, 'I'm in labor. I'm going to have it right now.' My manager said, 'What should we do?' I said, 'It's an emergency and we have to do something.'

"He and I grabbed Subway wrappers and trash bags and rags that we use in here, and put them on the restroom floor so there was sanitation. Everything happened so fast," she added.

After the birth, the 30-year-old Vargas held the mother's hand and assured her the boy was healthy. The mother reacted by "crying a bit but seemed to be OK," she said.

Vargas said though she's "really happy" about how things turned out, she urged her boss to provide training to employees on how to deliver babies.

Raising more than $700, students aid tornado victims

In late May, the Eagle Hill Lower School Leadership Council, Mrs. Connolly?s Study Skills Class, and the Upper School Student Council combined their efforts to raise more than $700 through a bake sale to assist the victims of the tornado in Oklahoma. All funds will be sent to the Red Cross to assist them in their efforts.

This is just one of the many projects the students at Eagle Hill School take on each year in their desire to be better connected to the global community. In their classes and through community service events, the students learn about world issues and concerns, and investigate ways in which they can lend their assistance to make life easier for those around them, or when tragedy hits.

In the last few years, the students have raised funds and/or provided their time and energy for local charities such as Adopt-a-Dog, Neighbor to Neighbor, St. Luke?s Soup Kitchen, Sweet Readers and others.

Globally, their energies have been directed towards the Red Cross for hurricane relief (after storms like Katrina and Sandy) and an orphanage in Africa, to name a few.

    Cleburne GOP head Sprayberry to challenge Dial for Senate

    slideshow State Sen. Gerald Dial, 75, will face a Cleburne County challenger for his seat in the 2014 Republican primary election June 3.

    Tim Sprayberry, 47, Cleburne County Republican Party chairman, in July began raising money and campaigning against the seven-term senator.

    Dial is serving his first term as a Republican. He had previously served two terms in the Alabama House of Representatives and six terms in the State Senate as a Democrat. He lost an election in the Democratic primary for the District 13 Senate seat in 2006. In 2009, he switched to the Republican Party and won back his former seat.

    There is some discontent among Republicans with some of the former Democrats who have switched to the Republican Party, said Sprayberry.

    ?I believe Sen. Dial is still a Democrat,? Sprayberry said. ?I don?t believe he represents the values we believe in as Republicans.?

    Dial, who spoke by phone Friday from the Alabama Farmers Federation Commodity Producers Conference in Birmingham, said he welcomes the competition.

    ?We look forward to the campaign,? Dial said. ?But, right now we?re working to bring jobs to Alabama.?

    Dial said he was a little surprised to hear Sprayberry, the head of Cleburne County?s Republicans and someone he?s known for years, was running against him. But Dial noted that Sprayberry has run for office before, including an unsuccessful campaign for the House of Representatives District 39 seat in 2010. District 39 represents Cleburne, Cherokee and Dekalb counties.

    Dial said he plans to run in the upcoming election because he has some unfinished business. He would like to see the sales tax on groceries abolished and to pass a bill he filed last year and has pre-filed again this year to move state schools to online textbooks.

    ?My goal is to serve one more time,? Dial said. ?As majority whip, I?m in a position to have some real influence.?

    But he said if he wins in 2014, it would be his last election. He?s ready to retire from political life and work on his book, Dial said.

    Sprayberry said if he could turn back the clock, he would have run against Dial in 2010. But he was intimidated by the size of Dial?s campaign fund. This time, Sprayberry thinks he might have a chance to take the seat, he said. Both men filed have filed campaign finance reporting waivers because they have not yet raised $10,000.

    Sprayberry works as a private investigator at his own business, Sprayberry Investigations, in Heflin. He?s had the business since 1998 when he left law enforcement, Sprayberry said. He decided two years ago to leave a job at Forte Power Systems, a wire and cable manufacturing company, and work as an investigator full time, Sprayberry said.

    If elected, Sprayberry plans to work for smaller government and lower taxes as well as protecting gun owners? rights and state?s rights, he said.

    Senate District 13 includes parts of Cleburne, Clay, Chambers, Cherokee, Lee and Randolph counties.

    The qualifying deadline for the 2014 primary election is April 4.

    Apple's iPad Mini 2 decided to make a round of the news channels today with a couple of leaked images that show off the aluminium body cover of the sequel to the hit iPad Mini 7.9" tablet. The iPad Mini will reportedly pack the same design as the original tablet. Looking at these new leaked images, we can confirm one thing. The next-generation iPad Mini won't change anything superficially. All the changes that you'll be experiencing will be under the hood. Of course, a retina display would technically still be above the hood, but you get what we mean. Apart from a high-resolution display, the iPad Mini 2 will allegedly get blessed with much more powerful specifications this time round, after Apple put an old chipset in the original.

    Dems hit GOP on immigration in top critics home

    AMES, Iowa (AP) ? Kicking off an August of likely intense debate over immigration, the Senate?s second-ranking Democrat traveled to Iowa Friday to rebuke House Republicans who oppose major changes embraced by the Senate.

    Sen. Richard Durbin?s strategically targeted visit was a fairly small and calm foretaste of planned demonstrations by opponents and supporters of the proposed immigration changes during Congress? summer recess. The Senate measure would heighten border security and provide a pathway to citizenship for millions of immigrants living here illegally.

    Durbin, of Illinois, joined Iowa Democratic Sen. Tom Harkin at a forum in a college town represented in Congress by Republican Rep. Steve King. King is among Congress? fiercest opponents of granting citizenship to immigrants now here illegally. Republican leaders have denounced King?s most inflammatory remarks, but some Democrats depict him as a symbol of widespread GOP resistance.

    Harkin said Iowans ?are compassionate, caring people and we don?t characterize people with hateful, spiteful, degrading language.?

    King said in a July interview that some Hispanics brought to the country illegally as children become high school valedictorians. But for each of those, he said, ?there?s another 100 out there who weigh 130 pounds, and they?ve got calves the size of cantaloupes because they?re hauling 75 pounds of marijuana across the desert.?

    Durbin focused on the so-called DREAM Act, which would offer eventual citizenship to some immigrants brought illegally to the U.S. as children.

    ?If we can fix this immigration system, we can build the American economy and we can do the right thing,? Durbin told the Ames gathering. ?To suggest these are petty criminals or drug smugglers just doesn?t square with the reality of the DREAM Act.?

    The forum featured potential DREAM Act beneficiaries.

    Hector Salamanca, 20, came from Mexico as a child with his parents, who stayed in the United States after their tourist visas expired. His undocumented status made him ineligible to attend a state university or receive government-sponsored grants or loans, he told the audience of about 200.

    Salamanca said he earned an associate degree at a community college and will attend Drake University. He said he tells Hispanic youths, ?Don?t let your undocumented status prevent you from achieving your goals.?

    Some House Republicans have expressed interest in a version of the DREAM Act, although King calls it ?backdoor amnesty.?

    The Obama administration and many activist groups have said they will not settle for the DREAM Act alone. They are pressing the GOP-controlled House to embrace something similar to the Senate bill.

    Many House Republicans resist the idea. They point to GOP primary voters in their districts who oppose ?amnesty? for people here illegally, and who say a Democratic administration can?t be trusted to keep promises to tighten the border with Mexico.

    Durbin noted that President Barack Obama won re-election with strong backing from Hispanic and Asian-American voters. Many Republican strategists say their party must improve its relationship with these groups, and backing broad immigration changes could help.

    ?If Republicans in the House don?t respond honestly and in a comprehensive way, this will continue to overshadow any other political issue among certain groups of Americans,? Durbin said.

    Opponents of the Senate bill say they will use the August recess to stiffen House resistance. About 100 individuals and groups, led by the Tea Party Patriots, sent a letter this week to all House members expressing opposition to any legislation ?that bears any resemblance to ... the Senate amnesty bill.?

    Meanwhile the pro-immigration-reform group America?s Voice said its activists ?are on the move with hundreds of grassroots events planned from coast to coast? this summer.

    Demonstrators, who support legalization for millions now here illegally, blocked a major street outside the U.S. Capitol on Thursday, and some were arrested.

    Rep. Devin Nunes, R-Calif., said such protesters do their cause more harm than good.

    ?People just see it as a campaign,? Nunes said in an interview Friday. ?People get their feet set in cement when they see campaigns going on.?

    King, meanwhile, said he was mourning the death of a Vietnam War hero on Friday rather than responding to Durbin?s and Harkin?s visit to his district.

    S&P 500 index has first close above 1,700 points

    NEW YORK (AP) ? Stock indexes are back at record highs on Wall Street after better economic news sent the market sharply higher.

    The benchmark Standard & Poor's 500 index closed above 1,700 points for the first time.

    Better manufacturing news in China and the U.S. as well as encouraging reports on jobs and company earnings sent the market up Thursday.

    The S&P 500 rose 21 points, or 1.3 percent, to 1,706.

    The Dow Jones industrial average gained 128 points, or 0.8 percent, to 15,628.

    The Nasdaq composite rose 49 points, or 1.4 percent, to 3,675.

    Small-company stocks and transportation stocks also rose sharply. Investors sold ultra-safe U.S. government debt.

    Three stocks rose for every two that fell on the New York Stock Exchange. Volume was higher than average at 3.8 billion shares.

    Aimco Promotes Executive Vice President John Bezzant to Chief Investment Officer

    As millions of Americans go gluten free, FDA sets the standard

    Hostaria del Piccolo in Santa Monica serves spaghetti, penne and chocolate tortino without it. Dunkin' Donuts is developing a cinnamon-sugar doughnut free of the substance. There are even wedding cakes, hand soaps and toothpastes with barely a trace.

    The ingredient non grata is gluten, a protein found in wheat, barley and rye. It allows breads to rise and binds ingredients together. So ubiquitous is the stabilizing compound that it can be found in ice cream, ketchup and deli meats.

    For the estimated 3 million Americans with celiac disease, a single bite of a food made with gluten can cause gastrointestinal distress that may take two weeks to resolve. But a growing number of Americans without the disease are shunning it too, believing it will help them with digestive issues, skin and respiratory problems, weight loss or "brain fog," or just improve their general health.

    With one-third of Americans trying to avoid the protein, the "gluten free" label holds increasing cachet. On Friday, the federal government issued an official definition of that claim, bringing a measure of uniformity to a burgeoning industry.

    According to the Food and Drug Administration, a food or other substance can be labeled "gluten free," "no gluten," "without gluten" or "free of gluten" if contains less than 20 parts per million of it. Manufacturers have until Aug. 5, 2014, to comply with the new definition.

    Hillary Kane, operations director at the Celiac Disease Foundation in Woodland Hills, said the FDA action would greatly ease the lives of people with the autoimmune disorder.

    "The entire community is elated," she said.

    In announcing the definition, FDA Commissioner Margaret A. Hamburg said the agency's rule would "help people with this condition make food choices with confidence and allow them to better manage their health."

    But the vast majority of beneficiaries will be those who have embraced a gluten-free lifestyle without an official medical diagnosis. (There are so many of them that "Saturday Night Live" poked fun at the fad in one of its fake commercials, describing it as a "made-up allergy that you invented just to get attention.")

    For people without celiac disease, the medical benefits of dropping gluten are unproven. Yet for many people, going without gluten seems to be the natural next step after becoming vegetarian, then vegan. Celebrities have put it in the spotlight: Gwyneth Paltrow included gluten-free recipes in her cookbook, "It's All Good," and Chelsea Clinton's wedding cake was made without it.

    Some parents believe their children's autism symptoms improved when they stopped eating gluten and casein (a protein found in milk products), though there's no scientific evidence to support their observations.

    Even industry analysts have been surprised at the strength of the gluten-free claim, said Tom Vierhile, innovation insights director at Datamonitor Consumer, which tracks the introduction of new products into the U.S. market. So far this year, more than 18% of the new foods sold in stores make a gluten-free claim, the firm said. That's up from 11.5% in 2012 and 11.7% in 2011.

    Just two weeks ago, the Whole Foods store in Mid-City Los Angeles rearranged its products to make room for a 39-foot aisle devoted to gluten-free products. Entire gluten-free stores have popped up, including Bite Market in Orange and Pam Mac D's Gluten-Free Market in Burbank.

    A report from the Dallas-based research firm Markets and Markets said the global market for gluten-free food could reach $6.2 billion by 2018, with North America accounting for nearly 60% of that.

    Health authorities estimate that 1 in 133 people have celiac disease, but that many of them are undiagnosed. A larger group of people may have an intolerance for gluten, a condition that's still not well understood.

    In people with celiac disease, foods that contain gluten trigger production of antibodies that attack and damage the lining of the small intestine. Such damage limits the ability of celiac disease patients to absorb nutrients and puts them at risk of other very serious health problems, including nutritional deficiencies, osteoporosis, growth retardation, infertility, miscarriages, short stature and intestinal cancers.

    Until a few years ago, bread bakers were among the few people who paid much attention to gluten.

    The gluten-free life, however, is undeniably a diet du jour.

    "The fad nature of it has ... put a lot of confusion out there," said Carol Shilson, executive director of the Celiac Disease Center at the University of Chicago.

    As with so many nutrition fads, there's more than enough confusion to go around. How can chefs take people seriously when they demand a meal free of gluten but order cake for dessert?

    Restaurants including the popular Susan Feniger's Street are getting "many more" calls for gluten-free dishes, said general manager Shireen Saugen. Dishes such as the grilled artichoke tossed in vinaigrette or the salmon tataki are good for people who don't eat gluten. And dishes such as the shaved kale and Brussels sprouts, usually served with bread crumbs, can be modified, she said.

    Jessica Pantermuehl, an L.A.-based holistic nutrition counselor, said gluten is found in many unexpected places, making gluten-free shopping confusing for many people. The FDA regulation will help change that, she said.

    "I think it is very helpful for people so they know what they're eating, so they don't have to dive into many hours of education to understand that gluten can be in hydrolyzed vegetable protein, for example," she said.

    Indeed, gluten turns up in many processed foods that are not so obvious, including sauces, packaged entrees and flavorings. Alice Bast, founder and president of the National Foundation for Celiac Awareness in Philadelphia, said a colleague recently ordered a Caesar salad in a restaurant before learning that the chicken in it contained barley malt ? something those with her diet call "being glutened." (Luckily, she discovered this before she took a bite.)

    The FDA noted that its 20 ppm standard has been generally accepted by many food companies and third-party certifiers. As such, the regulation will separate out the food manufacturers who see gluten-free as a buzzword to sell their food but don't make sure their products comply, said Kane of the Celiac Disease Foundation.

    Kane recalled the early days of the fat-free label, when produce aisles had signs for "fat-free grapefruit." She said she suspected shoppers could see signs on water or broccoli touting their lack of gluten ? if that might mean higher sales.

    GETTING MORE INTENSE: The rhetoric escalates in the debate over the first horse slaughter facility in the U.S. in seven years.

    The debate over a horse meat processing plant keeps getting more intense.

    One day after New Mexico Watchdog first reported that the Navajo Nation supports a controversial horse meat processing plant in Roswell, two state representatives who are members of the tribe agreed, saying the Valley Meat Co. should be able to open its doors as the first horse slaughterhouse approved in the U.S. in seven years.

    And one of them criticized Gov. Susana Martinez for opposing the facility and accused former Gov. Bill Richardson of ?grandstanding.?

    ?The feral horses are destroying (earthen dams) and fences in an attempt to get at crops and feed, making things unusable for the productive livestock that tribal members rely on for their livelihoods,? Rep. Sandra Jeff, D-Crownpoint, in a statement late Thursday to New Mexico Watchdog.

    ?These feral horses are not domesticated nor are these horses considered pets, while many such as Gov. Martinez would have you believe otherwise,? Rep. Jeff said.

    Martinez, a Republican, has opposed the horse slaughter facility, saying that ?horses are a part of our culture.?

    Last week in a statement with actor Robert Redford, Richardson signed on to a lawsuit against the facility. Fellow Democrats such as State Land Commissioner Ray Powell and Attorney General Gary King also have expressed opposition.

    ?These people want to tell us how to manage our land and our lives, but are unwilling to provide financial backing to fund their agendas,? Jeff said. ?They would rather spend their money on lawsuits and chase media.?

    The statement accused Richardson and others of ?political grandstanding.?

    Rep. Sharon Clahchischilliage, R-Kirtland, who is a member of the Navajo Nation, also came out in favor of the horse slaughterhouse but used more dispassionate language.

    ?The problem with wild horses is immense,? Clahchischilliage said Thursday. ?Something needs to be done.?

    ?You can?t slaughter your way out of this problem,? countered Phil Carter of Animal Protection New Mexico, who says more humane alternatives exist, such as gelding stallions and injecting horses with contraceptives.

    The plant has stoked a furious debate inside and outside the borders of New Mexico, with supporters of the facility saying it?s necessary in part because of the numbers of feral horses scattered across the state, many of which that have been abandoned due to the high price of hay, while critics say the killing of the horses is cruel and gives the state a bad reputation.

    The facility has become increasingly divisive and has caused splits among Republicans and Democrats as well as rural, urban and conservation groups.

    Last week, Rep. Candy Spence Ezzell, R-Roswel, who often speaks from the House floor of her love for horses, came out in support Valley Meat Co., telling the Texas-New Mexico Newspapers Partnership, that irresponsible owners are abandoning horses on ranches, reservations and public lands, where they eat vegetation, drink up water in drought-ridden areas and sometimes starve to death.

    ?In my area, we have so many wild horses that are breaking down fences, you can?t believe it,? Clahchischilliage said.

    The Navajo Nation estimates that 20,000 to 30,000 feral horses are roaming throughout the reservation?s 27,425 square miles.

    ?A lot these horses have no owners, they?re not branded,? Clahchischilliage said.

    Emotions are running high.

    Last weekend, the owners of the Valley Meat Co. reported a fire on the company?s property and Chaves County officials say they suspect arson.

    U.S. District Court judge will hear arguments Friday from opponents of the horse slaughter plant who have filed a motion to keep the plant from opening.
